I went to work for Apollo Transfer Company LLC in June 2009 as a truck driver, under contract with Penske Truck Rental, in Colorado Springs, Colorado. We were very busy through the summer months and into the fall, then things began to slow down and I was on standby, but I had to show up at the "yard" by 7 am Monday through Saturday; the yard was a Penske district yard.

We were told that we had to keep complete records of every driving assignment, which I did. The record included day and time, location of the starting assignment and the termination of that assignment; miles driven were included, truck number and identification were required as well.

Apollo made it very clear that they could fire us for any reason and for no reason as well. We had to fax our driver's log to their head quarters in Tempe, AZ at the end of each week; of course, I faxed my log book to them every Saturday.

Their rules would pay us for driving an assigned truck to an assigned destination. They would not pay for the trip to pick up the assigned truck. For example, I drove from Colorado Springs, CO to Grand Junction, CO a five and half hour trip to pick up a truck and return it to Colorado Springs, towing the chase car I drove to Grand Junction. I got paid for the trip from Grand Junction to Colorado Springs. They did not pay me for the drive to Grand Junction! Furthermore, they paid only the miles they figured the trip to be and not for the actual mileage driven!

The Penske district in Colorado Springs was not renewed and Apollo moved its operation to Denver. I could not afford to drive the 65 miles to Denver from Colorado Springs to work for Apollo; so in June of 2010 I was laid off.

I started auditing my pay check log for paid assignments and discovered that Apollo ripped me off big time. They cheated me out of $17,500.00 over the period of one year! They intentionally and purposefully did not pay for driving, down time, labor I did for them.

I filed a complaint with the Department of Labor in Colorado and they mailed Apollo a summons to an arbitration hearing in Denver. Apollo did not appear and the department of labor issued a letter of non-compliance regarding Apollo. This meant that Apollo was now liable to pay for all of my costs legal and other fees in the collection of the money they stole from me; yes stole, its called theft of wages!

I tried to find an attorney who would take the case, no luck, they wanted retainers and fees paid up front; I'm unemployed! This meant that I had to file a complaint in small claims court, maximum amount they would consider is $7,500; in other words I had to give up half of the wages Apollo stole to get some "justice".

I filed a complaint in Small Claims Court in June of 2011. It is now January 2012 and Apollo's owner is still hiding from the process server. I am being victimized by Apollo, attorneys, the Department of Labor, they have no authority of force of law--they can't compel an employer, the process server, there is no justice for the little guy in America!

There is a lawsuit under way against apollo right now in federal court in Phoenix. The attorney is Nicholas Enoch 602-234-**** ask for Christina she is the lead person helping us with the details. Good luck

Apollo dispatch is in the same office of Apollo Logistics, Transfer Company, in Tempe Az. The owner of the company has an office over looking the dispatchers and he is clear to them on what to log in for miles driven and how to omit trips, short the miles.

Further more, state law says if you are on site on call they are to pay you a wage as if you are a W2 on the clock! Apollo makes a living at ripping off its drivers.

I currently drive as a independent driver for Apollo, and I read a lot of negative post. Well I have to say Apollo may not be the best company but there are other companies that are worse. Yes, they have you (dead head) a lotand no you do not get paid for dead heading but they tell all drivers that befor you start! And the pay isn't the best but you make enough to live. Myself, I can not complain. I think most of the complaints by drivers aand ex drivers (most of these complaints) come from many of the drivers that can not or do not manage their money properly. You are a independent driver when you drive for Apollo. If you want the miles you go where the trucks are, if you do not want to go there you tell your dispatcher! .. And the pay.... you are paid by Apollo (X) amount of dollars for a trip. Most times they over pay you 20.00 dollars to 40.00 per trip. If a driver manages their (pre payment) for the trip you should have cash left over. The drivers must keep ( ALL THEIR RECEIPTS ) for the trip. Here is how it works.

Apollo gives a driver a trip. They tell the drivers up front how many miles they get paid for (and their milesare correct give or take a few miles) Apollo then loads ( let's say ) 225.00 on the drivers ComData card. 200.00 of that is trip money for fuel, toll roads etc. 20.00 is a personal advance for food. And 5.00 to cover comdata and atm charges. Of at this time you now owe Apollo 225.00 dollars. But at the end of the job you have all you receipts fuel , tolls etc and they equal out to say 198.00 you now owe Apollo 27.00. Apollo does not pay for your food! And they tell drivers that when they start! I don't know of to many companies that do! And you do not have to accept or ask for the personal advance if you do not want it! 5.00 of the 27.00 are atm and comdata charges to use your card and yes there is a charge just as there is on any debit card. Now you had 2.00 left from the trip advance so you kept that in your pocket, but if you used that 2.00 for something for the truck and have the receipt you will get that back but say you don't have a receipt you have that 2.00 in your pocket so you do owe them for it. Ok so say you don't have a receipt for the 2.0. And they gave you a 20.00 advance plus the 5.00 for comdata and atm fees you are in the whole 27.00 because that is money they gave you to do a job you have been contracted to do. So say that trip you drove that truck 180 miles and you get paid say .23 cents a miles your pay on that job is 41.04 so you must repay. Apollo that 27.00. Your pay for that trip. 14.04. Now realize say Apollo gave you an advance of 225.00 and you have receipts for the fuel, tolls etc that equal 225.00 you wouldn't be in the hole at all... I hear drivers complain but if you manage your money they give you as an advance before the trip you will do well. Remember that money they advance you as a driver isn't your money it is still Apollos money they have gave you as an advance to get the job you as a driver had/has been contracted to do.

Actually I am a driver for Apollo as well out of Macungie, Pa. I do have a CDL-A license and was hired on the spot. My pay was as Norm states, The same rate. And how it worked was a small group of us would deliver new trucks from Mack regionally to Baltimore, or down to NC, and we would get a rental car back with all miles logged with the proper times, mileage sheets and recipts. When you get a job you can agree to it or not, but if you work with the guys that I did, everything would go smoothly.

Pay is smooth now, with hardly no hangups as long as you have your receipts handy. (I carry a small zipper pouch that I have in my clothes bag in case we have a layover. I use that to keep ALL my recipts in order for each trip accounting for each dollar.)

Yes, you might bust your *** driving trucks, but the ones I drive are brand new from Mack delivered to dealers or customers, or to the Docks at Baltimore using a TWIC card. (If ya need a Twic, you pay for it thru payroll deduction, but that pays $100.00 per trip, per truck.)

This was back in 2010, and I left after getting a newer job, but kept in touch with Greg at Tempe.

I am now hired again, and Greg stated that my pay also includes .10 a mile for any deadheading that we all get as a group picking up trucks, or returning from neighboring states away after delivery. This is applicable for riding back any miles from Allentown which is 5 miles away, up to 50 dollars for a 500 mile trip to Wisconsin picking up the UPS trucks from their factory.

Now this is for a cdl position and I don't know the pay scale of the non CDL drivers, but that is what I'm paid.

All you have to do is watch your recipts, track the dollars, and get paid.

Norm. After working one week for you I can say this.

Your job sucks. I worked for 4 trucking companies after you. Your company is getting sued for a good reason. Too much non compensated time for work.

How can you expect to drive all those miles unpaid for.. Find a new job

:( I tried to sue Apollo Transfer but no attorney would take the case without a LARGE retainer fee; I even have a ruling by the Colorado Department of Labor that Apollo is ruled to pay all fees and costs!!!!!!!!! I recently had to file bankruptcy to save my home from foreclosure.

I notified the Chapter 13 court of the $17,500.00 Apollo owes me. This amount of rip off occurred in one year!!!

I can prove it because I have all of my logs and assignment data.
